EnthiosHub — Limitation of Liability

This policy consolidates the limitations and exclusions of liability applicable to the EnthiosHub Services. It forms part of, and is read with, the Terms & Conditions. Nothing here excludes liability that cannot be excluded under Applicable Law.

1. Intermediary Disclaimer#

1.1. EnthiosHub is a technology intermediary. It is not the organizer, host, seller, sponsor, or provider of any Event and is not a party to the contract between an Organizer and an Attendee.

1.2. The Company is not responsible for the acts, omissions, conduct, quality, safety, legality, or performance of any Organizer, Attendee, vendor, sponsor, or other third party, or for any Event.

2. "As Is" Basis#

2.1. The Services are provided "as is" and "as available" without warranties of any kind, express or implied, to the maximum extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

2.2. The Company does not warrant uninterrupted, secure, or error-free operation, or that any Event will occur or meet expectations.

3. Exclusion of Indirect Damages#

3.1. To the maximum extent permitted by law, the Company and its directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for loss of profits, revenue, data, goodwill, business, or opportunity, arising out of or relating to the Services or any Event, regardless of the theory of liability and even if advised of the possibility of such damages.

4. Aggregate Liability Cap#

4.1. To the maximum extent permitted by law, the Company's total aggregate liability arising out of or relating to the Services or the Terms shall not exceed the total Platform Fees actually received by the Company from the claimant in respect of the specific transaction giving rise to the claim, or INR 5,000, whichever is lower.

5. Event-Related Claims#

5.1. Any claim relating to an Event (including cancellation, quality, injury, loss, or damage) lies against the Organizer. The Company's role is limited to facilitation, and its liability is limited as set out above.

6. Third-Party Services#

6.1. The Company is not liable for failures, delays, or losses caused by third-party services (payment gateways, banks, email/SMS providers, hosting, connectivity) beyond its reasonable control.

7. Basis of the Bargain#

7.1. These limitations reflect a reasonable allocation of risk, are fundamental to the agreement between the parties, and apply notwithstanding the failure of essential purpose of any remedy.

8. Non-Excludable Rights#

8.1. Nothing in this policy limits liability for fraud, wilful misconduct, or any liability that cannot be excluded or limited under Applicable Law, including certain rights under the Consumer Protection Act, 2019.
